These Terms govern your use of vaclaimsfieldguide.com (the "Site") and your purchase of any product we sell, including the VA Claims Field Guide, the companion workbook, the rate sheet insert, and any free or bonus materials (together, the "Materials"). The Site and Materials are published by Hutch & Son's Enterprises LLC ("we," "us," "our").

By using the Site or purchasing the Materials, you agree to these Terms. If you do not agree, do not use the Site.

1. What this is, and what it is not

The Materials are educational reference publications. They explain how the VA disability claims system works, what the published rating criteria say, and what kinds of evidence the system uses.

The Materials are not:

  • legal advice, and no attorney-client relationship is created by buying or reading them;
  • medical advice, and no provider-patient relationship is created;
  • claims preparation, presentation, or prosecution;
  • representation before the Department of Veterans Affairs;
  • a promise, guarantee, or prediction of any claim outcome or disability rating.

Under federal law, only individuals accredited by VA — accredited attorneys, claims agents, and representatives of recognized Veterans Service Organizations — may prepare, present, or prosecute a claim for VA benefits on your behalf. We are not accredited and we do not offer those services. We charge for a publication only. We never charge a fee tied to a claim, a rating, or an award of back pay, and we never take a percentage of your benefits.

We are not affiliated with, endorsed by, or sponsored by the U.S. Department of Veterans Affairs or any government agency.

2. No guarantee of outcome

Your claim is decided by VA on the evidence in your file, applying federal regulation to your facts. Nobody — not us, not an attorney, not a VSO — can guarantee a service connection, a rating percentage, an effective date, or an amount of compensation. Nothing in the Materials should be read as such a guarantee.

3. Accuracy and currency

We cite the source for the criteria and procedures in the Materials so you can verify them yourself, and we intend for you to do that. Regulations, forms, portals, and rating criteria change, sometimes with little notice. The Materials state the date through which they were verified.

We make no warranty that the Materials are complete, current, or error-free at the time you read them. Always confirm anything that matters to your claim against the current text at ecfr.gov, va.gov, or with a VA-accredited representative.

4. Your license to use the Materials

When you purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to:

  • download, store, and read the Materials on devices you control;
  • print copies for your own use;
  • use the templates and worksheets in your own claim, and fill them in and submit them to VA;
  • share the Materials with your spouse, caregiver, or another individual directly assisting you with your claim.

You may not:

  • resell, sublicense, rent, or redistribute the Materials;
  • post them to a file-sharing site, forum, cloud drive, Facebook group, or any public or semi-public location;
  • reproduce them in any commercial product, course, coaching program, or service;
  • strip, alter, or obscure any copyright notice, watermark, or attribution;
  • use the Materials or any portion of them to train a machine learning model.

We retain all copyright and other intellectual property rights in the Materials. Nothing in these Terms transfers ownership.

We may revoke your license and disable access if you materially breach this section.

5. Government works

Portions of the Materials quote or paraphrase federal regulations, statutes, and VA forms, which are works of the U.S. government and are not subject to copyright. Our selection, arrangement, explanation, and original commentary are ours.

6. Purchases, delivery, and pricing

  • Prices are in U.S. dollars. The introductory price and its expiration date are stated at checkout and are what govern your order.
  • Payment is processed by Stripe. We do not receive or store your full card details.
  • The Materials are delivered digitally. Access instructions are emailed to the address you provide at checkout. If you do not receive them within one hour, check your spam folder and then email support@vaclaimsfieldguide.com.
  • Purchase includes the current edition, the workbook, and the current rate sheet insert. Rate sheets are updated annually and sent to purchasers at no additional charge. Future editions of the guide are separate products and are not included.
  • You are responsible for any sales, use, or value-added tax that applies in your jurisdiction, unless collected at checkout.

7. Refunds

Our refund terms are set out in the Refund Policy, which is part of these Terms.

8. Chargebacks

If you have a problem with your order, email us. We will issue a refund within the refund window without question. Initiating a chargeback instead of requesting a refund is a breach of these Terms, and we reserve the right to terminate your license, dispute the chargeback with the evidence of delivery, and decline future sales.

9. Third-party links and resources

The Materials and the Site link to government sites, VSOs, and other third-party resources. We do not control those sites and are not responsible for their content, accuracy, or availability. A link is not an endorsement.

10. Acceptable use of the Site

Do not attempt to gain unauthorized access to the Site, interfere with its operation, scrape it at volume, or use it to transmit malware or unlawful content.

11. Disclaimer of warranties

The Site and Materials are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, Hutch & Son's Enterprises LLC and its owners and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost benefits, lost compensation, lost back pay, missed deadlines, or claim denials, arising out of or relating to the Site or the Materials.

Our total aggregate liability for any claim relating to the Site or the Materials will not exceed the amount you actually paid us in the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your misuse of the Materials, your breach of these Terms, or your violation of any law or third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Jefferson County, Colorado, and you consent to that jurisdiction.

Before filing anything, you agree to email support@vaclaimsfieldguide.com and give us 30 days to resolve the issue informally. Most problems are a refund and a handshake.

15. Changes

We may update these Terms. Changes apply prospectively from the "Last updated" date. Your purchase is governed by the Terms in effect on the date of your order.
